| Synopsis | The IPBA’s Japan Chapter has recently launched a comparative study project on the litigation systems in various Asian jurisdictions. At this session, panelists will discuss from a comparative viewpoint the varying features of such litigation systems, including service of process, discovery, preliminary injunctions, the use of juries, examination of witnesses, lawsuit stamp duties, qualifications for judges and other practical issues such as the reliability of the courts, actual practices inside and outside of courts, etc., for seven jurisdictions (China, India, Korea, Singapore, Thailand, Taiwan and Japan). | |||||||||||||||

| Synopsis | This session is a sequel to earlier session in 2010 IPBA Singapore Conference and will explore various issues relating to M&A negotiation trends and practices and compare similarities and differences in the United States and other Asian countries. Asia-Pacific is becoming an increasingly important part of the world for cross-border M&A transactions. Whether cross-border M&A transactions within Asia or M&A transactions of Asian companies in the USA, Europe or emerging markets - the recent trend brings about new challenges but also new opportunities for the lawyers inside and outside the region. Experienced M&A practitioners from various jurisdictions will talk about their own experience and important developments in their own jurisdictions. As a panel they will discuss how the cultural differences and different mentalities influence the way M&A transactions are being conducted in various Asian countries, how lawyers can organize and handle cross-border transactions for their clients and which lessons can be learned for practitioners active in the Asia-Pacific region. | |
